1. Acceptance of Terms and Eligibility

• You must be at least 18 years of age and legally competent to enter into contracts under the Indian Contract Act, 1872 or applicable laws to use the Website.
• By using the Website, you represent that you meet these requirements, will use it only for lawful purposes and comply with all applicable laws.
• If you are accessing the Website on behalf of a business / corporate organisation, you represent that you have authority to bind that entity by your actions undertaken on the Website.
• By interacting on the Website and / or purchasing from Qween through the Website, you warrant that you are not: (a) a minor; (b) a person under sanctions or on a government watchlist; (c) a bot or automated scraper.
• Use of this Website is exclusively at the sole risk of you. Any reliance upon the material of this website shall be at your own risk. You agree that it is your responsibility to monitor any changes to the material and the information contained on this Website.

2. Permitted and Prohibited Uses

Permitted: The Website allows browsing products and placing orders. You may use it for personal and non-commercial purposes only.

Prohibited: Data scraping, using bots, unauthorized linking, trademark misuse, copying content, uploading harmful content, reverse engineering, interfering with the Website's functionality or any unlawful activity.

3. User Accounts

Create accounts with accurate information. By signing up and creating an account on the Website, you hereby declare and represent that you have provided us with accurate information regarding yourself, and all profile and KYC details submitted voluntarily by you are true, accurate, complete and consistent.

Unauthorized use. You are responsible for maintaining confidentiality and security of login details. Please immediately notify us of any detected unauthorized use. We may suspend or terminate accounts for actual or suspected breaches. We shall not be liable for any loss of data, loss of profit, or any other losses of any kind due to your negligence.

4. Intellectual Property Rights

• All content, designs, logos, product images, and trademarks on the Website are our exclusive property or licensed to us. You may NOT reproduce, modify, distribute, or commercially exploit any content without prior written consent. Qween grants users a limited, non-exclusive, revocable license to access and view content for personal, non-commercial purposes only. No reproduction of any part of the Website may be sold or distributed for commercial gain, nor shall it be modified or incorporated into any other work, publication, or website.
• Using Qween's trademarks / logos without written permission is prohibited, subject to exemptions granted under applicable law in India. Scraping website content via bots or automated tools, creating derivative works (including AI-generated designs based on Qween's products), and reproducing our catalogue for competitive purposes is strictly prohibited. Nothing contained on the Website should be construed as granting any license or right to use any trademark displayed on the Website.
• User generated content. You retain full copyright and ownership of any review, photo, video, or testimonial you upload (“UGC”). By uploading UGC, you warrant that:
  • you are the original creator (or have permission from the creator);
  • the UGC does not infringe third-party rights (copyright, personality rights, privacy); and
  • the UGC is not obscene, defamatory, or otherwise illegal.

  If you upload any UGC that infringes third-party rights, or is illegal, obscene or defamatory, you agree to indemnify Qween from any claims or losses incurred by Qween pursuant to such UGC.

  By uploading UGC, you grant Qween a worldwide, royalty-free, perpetual license to:

  • display the UGC on the Website, marketing materials, social media, and advertisements (with your name / profile as attribution);
  • modify the UGC (e.g., crop photo, add watermark) for display purposes only;
  • sublicense the UGC to media partners/influencers (with proper attribution);
  • analyze sentiment/feedback for product improvement; and
  • use product images / descriptions / feedbacks to train AI / ML models for product recommendation engines, image search / similarity matching, general AI training, etc.

  You may request removal of your UGC anytime by email to concierge@qween.com. Qween shall remove the UGC within 7 days, except where legally required to retain. After removal, Qween may retain a non-public archive for 1 year (pursuant to legal requirements) and then delete such archive.

5. E-Commerce Transactions

• Orders: Product images, descriptions and prices are invitations for offer by Qween. Qween is obligated to accept your offer only upon payment confirmation and order acknowledgement.
• Orders are subject to acceptance and availability. Qween does not guarantee product availability, accuracy of description, and price accuracy. Prices are subject to change without notice (unless otherwise specifically agreed as part of any other scheme or policy of Qween).
• Payments: We use secure payment gateways for processing payments. All payment information is encrypted and processed in compliance with the Payment Card Industry Data Security Standard (PCI-DSS). Prices exclude taxes unless stated. Additional GST may be applicable on the listed price, which shall be duly disclosed on the checkout page. In case of any payments related disputes, please write to us at grievances@qween.com.
• Cancellations: We may cancel transaction for stock issues, KYC inadequacies, or pricing errors.
• Returns: As per our Returns and Refunds Policy.
• Changes in Offers: Online offers are subject to change without notice, at the discretion of Qween.
• All sales are final post-dispatch, subject to our return and refund policy.

6. Jewellery Products

• Authenticity: All products containing gold, silver, platinum, or other precious metals shall be hallmarked as per Bureau of Indian Standards (“BIS”) regulations. The purity of the metal is guaranteed as per the hallmark assayed and stamped on the product. Qween shall provide a purity certificate for you, if requested for, at the time of purchase.
• Variations: There may be commercially accepted variations in purity of natural gemstone / diamond.

7. Shipping and Delivery

• Shipping: Qween fulfils shipping within India only. International shipping is not currently available. However, you may contact customer service to discuss special arrangements.
• Delivery: Delivery timelines are provided upon submission of your Pin Code at checkout and are indicative estimates based on the following factors:
  • Current warehouse stock availability;
  • Logistics partner capacity and regional demand;
  • National holidays and festivals;
  • Weather conditions and seasonal factors; and
  • Unexpected operational disruptions.

  Actual delivery timelines may vary by 5–7 business days from the estimate provided. Qween shall not be liable for delays within this variance.

• Shipment Tracking: Upon dispatch, you shall receive a tracking number via email and SMS (if opted in).
• Delayed Deliveries:
  • If delivery is delayed beyond the estimate by 10 business days, you may contact customer service to request an update and estimated new delivery date.
  • If delivery is delayed beyond 30 days from order confirmation, you may request cancellation and receive a full refund within 7 business days, subject to banking timelines.
• Guarantee: In case of any issues with the product upon delivery, we may provide a replacement / return / refund pursuant to returns and refund policy / warranty policy, as the case may be.

8. Privacy Policy

Your personal data and information is handled as per our Privacy Policy.

9. Disclaimers and Liability

Qween strives to describe the products / services / schemes listed on the Website accurately based on their actual specifications; however, minor variations are possible. You are advised to do your own due diligence prior to making any purchase from Qween or contact us in case of any disputes, conflicts or queries. The Website is provided “as is”; and we disclaim warranties for interruptions or errors. We may also take the Website offline for scheduled maintenance (system updates, security patches, improvements, etc.), and we will strive to provide users with at least 24-hours of advance notice by a banner on the Website regarding the scheduled maintenance. Orders made immediately prior or during the maintenance window may face temporary interruptions, and we will attempt to process any queued orders immediately after the maintenance window. Users are advised to avoid transactions during any scheduled maintenance windows.

Notwithstanding the above, liability of Qween (if any) shall be limited to the customer’s order value; and in no case shall Qween be liable to any consequential damages. The customer hereby acknowledges and agrees that jewellery involves natural variations; and the purity of metal is certified as per BIS standards.

10. Responsibility

We exclude, to the extent permitted by law, any liability whatsoever with respect to direct or indirect damage resulting from or related to the use, functioning or unavailability of the Website and its content. The settings of your browser, especially those refusing cookies, may make certain features and/or pages of the Website inaccessible. We shall not be held responsible for this.

11. Force Majeure

We are not liable for any delay in the performance or non-performance of any of our obligations hereunder and shall not be liable for any loss or damages caused thereby where the same is occasioned by any cause whatsoever that is beyond our control including but not limited to an act of God, war, civil disturbance, riots, strikes, lock-outs, governmental or parliamentary restrictions, prohibitions or enactments of any kind, pandemic, import or export regulations, exchange control regulations or accident or non-availability/ delay in transport.

Response Time: Grievances shall be acknowledged within 48 hours and resolved within 30 days.

13. Governing Law and Dispute Resolution

These Terms shall be governed by Indian laws, and courts in Bangalore shall have exclusive jurisdiction over any disputes pertaining to these Terms. User agrees that disputes shall first be resolved through arbitration under Arbitration and Conciliation Act, 1996, with the seat and venue for such arbitration being in Bengaluru, and the arbitration proceedings shall be held in English. The arbitration shall be presided by a single mutually appointed arbitrator, and the decision of the arbitrator shall be binding.

14. Termination

We may terminate access anytime for violations without notice. Provisions on IP, liability, and payments survive termination.

15. Cookies

Qween uses tracking technology (cookies), which helps make the Website more user-friendly, efficient, and secure. Cookies are small text files that are stored on your PC and used by your browser. Most of the cookies Qween uses are session cookies, which are deleted automatically at the end of your visit. Cookies will not harm your PC and do not contain any viruses. Nevertheless, if you do not want to use cookies, this will not prevent you from accessing the Website in any way. Your browser can be configured so that cookies can be accepted with your permission or completely blocked.

16. Changes to Terms

We reserve the right to make any changes, corrections or modifications to the Website and its content at any time. You agree that your continued use of the Website and services therein post notice of the update shall constitute acceptance of the updated Terms.
